Foliomoda - our Fees, Terms & Conditions
1. Foliomoda operates a Talent Scout service (FM Talent
Scout) for which an annual, non-refundable, subscription is
payable at £120.00 or €200.00 for four quarterly issues. A
client is deemed to accept these terms and conditions on
payment of the annual subscription, signing the recruitment
form or engaging a candidate.
2. This subscription entitles clients to see candidates,
with a view to their employment, listed on the FM Talent
Scout or listed on Foliomoda's books as seeking employment
at the time of enquiry.
3. Clients engaging a candidate through the above service
shall pay a fee at the following rates:
25% on the first year's
remuneration
Remuneration means the annual commencing salary to include
an actual or a notional figure for benefits and allowances
which form part of the total remuneration package in
accordance with the standard rates of Foliomoda in
evaluating such benefits from time to time.
All moneys due to Foliomoda shall be paid within 21 days of
the date of Foliomoda's invoice.
4. If the candidate’s engagement ceases for any reason
within three months and Foliomoda are informed in writing
of the fact within one week of its happening, a refund will
be made to the subscriber as follows:
If within one (1) month the whole fee
If within two (2) months two-thirds of the fee
If within three (3) months one -third of the fee
provided that the fee has been paid by the due date.
5. On behalf of their International clients Foliomoda also
undertake searches for Executives and Senior positions. We
also refer to this as Executive Scout. The fee for this
service is 30% of the first year’s remuneration payable as
follows:
One-third in advance
One-third on shortlisting
One-third on placement.
In the event of the client discontinuing the search for any
reason, tranche payments already invoiced are not
refundable.
6. In the event of a client requesting the engagement of a
candidate on a freelance basis, Foliomoda charge a fee
based on 25% of the total annual fee or remuneration. This
fee is payable either at the stage the freelance work is
completed on a seasonal or bi-annual basis, dependant upon
the work commissioned, or immediately a candidate is
commissioned by the client. Foliomoda reserve the right to
invoice the client on either basis at their discretion.
7. Freelance candidates subsequently retained on a full
time basis are charged at Foliomoda’s normal rates under
clause 3 or 5 and if appropriate the initial freelance fees
are refunded by Foliomoda or set off against the full fee
due from the client.
8. A client who passes on or introduces a candidate to any
other employer or, having declined a candidate on the first
introduction subsequently engages him, shall be liable to
the full fee under clause 3 or 5.
9. Whilst information given and representations (expressed
or implied) made to clients concerning the capability,
experience, suitability or integrity of any candidate
engaged by a client are true to the best of our knowledge
and belief, Foliomoda can accept no responsibility
whatsoever for any defect or omission in any such
information or presentation, or for any loss, damage or
expense resulting to a client therefore, or from any act of
omission on the part of the candidate.
10. Notwithstanding the terms of clause 09, the client
shall satisfy himself to the suitability of any candidate
for any vacancy and shall have the responsibility of taking
up references, checking the validity of qualifications,
obtaining any work or other permits and for ensuring the
designer satisfies any medical requirements.
11. In the event of Foliomoda advertising for any position
at the request of a client, Foliomoda will require the
payment of the cost of such advertisement prior to such
advertisement appearing. Such payment will not be
refundable.
